1. Acceptance of Terms
By creating an account, purchasing access to a course, or otherwise using the services offered at dogmadecoder.com (the "Site") and its associated subdomains, you agree to be bound by these Terms of Service (the "Terms"). If you do not agree, do not use the Site or purchase any course.
These Terms form a binding agreement between you (the "User") and Panisa Pochanard, doing business as dogmaDECODER ("we," "us," "our," or "dogmaDECODER"), a sole proprietorship operating from the State of California, United States.
2. Description of Service
dogmaDECODER offers educational products and services, including but not limited to:
- The MB Files: MB(ASCP) Exam Prep Course (the "Course") — a self-paced online study program
- Chapter content, flashcards, practice quizzes, practice exams, case studies, and reference guides
- Direct question-and-answer ("Q&A") access with the course instructor
- Certificate of Completion upon completing all course chapters
- Other educational content and resources as added from time to time
3. Account Registration
To access most paid content, you must create an account using a valid email address. You agree to:
- Provide accurate, current, and complete information
- Maintain the confidentiality of your password
- Promptly notify us of any unauthorized account use
- Be responsible for all activity that occurs under your account
You must be at least 18 years old to create an account and make a purchase. Accounts are personal and non-transferable. You may not share account credentials or allow another person to access the Site using your account. Account sharing is grounds for termination without refund.
4. License Grant
Upon purchase of the Course, dogmaDECODER grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Course materials for your personal, non-commercial educational use only.
This license is granted to one individual user only. The license is not transferable to colleagues, employers, classmates, students, family members, or any other person.
5. Intellectual Property
All content provided through the Course is owned by Panisa Pochanard, doing business as dogmaDECODER, and is protected by United States and international copyright, trademark, and other intellectual property laws.
Content includes, without limitation:
- Original illustrations, images, infographics, diagrams, and visual assets
- Chapter text, lessons, explanations, and written content
- Flashcards and their wording
- Practice exam questions, answer keys, and exam content
- Case studies and clinical scenarios
- Reference guides (PDF and HTML)
- Audio, video, and downloadable assets
- Site layout, design, branding, and trademarks
No transfer of ownership of any kind is granted to the User. The User receives only the limited access rights described in Section 4.
6. Prohibited Uses
You agree NOT to do any of the following with respect to Course materials:
- Distribute, share, or redistribute any Course materials, in whole or in part, to any other person or entity by any means (email, file sharing, social media, printed copy, classroom display, or otherwise)
- Copy, reproduce, or download Course materials for redistribution, training purposes outside your personal study, or any commercial purpose
- Modify, adapt, translate, or create derivative works based on Course materials
- Reverse-engineer, decompile, or attempt to extract source content from the Course platform
- Share account credentials with any other person, or allow another person to use your account
- Resell, sublicense, or commercialize Course materials in any form
- Use Course materials to create a competing product, course, or examination resource
- Use the Site or Course in any manner that violates applicable laws or regulations
- Engage in any activity that interferes with or disrupts the Site, including attempting to gain unauthorized access
Violation of these prohibitions may result in immediate account termination without refund, in addition to any legal remedies available to dogmaDECODER.
7. Access Terms
7.1 Course Content Access
Upon purchase, you receive access to all current Course content for the operational lifetime of the Course product. "Lifetime access" means for as long as the Course continues to operate as a product and service, not for the lifetime of the User. dogmaDECODER reserves the right to discontinue or modify the Course with reasonable advance notice to active enrolled users.
7.2 Direct Q&A Access
Direct Q&A access with the instructor is included for six (6) months from the date of enrollment. After six months, you retain full access to all Course content, flashcards, practice exams, and reference materials, but additional Q&A submissions will not be accepted through the Course platform. Extensions may be granted at dogmaDECODER's sole discretion for extenuating circumstances.
7.3 Certificate of Completion
A Certificate of Completion is awarded after you mark all Course chapters as complete. The Certificate represents course completion only and is not a professional certification or credential issued by any certifying body.
8. Educational Materials, Not Guaranteed Outcomes
The MB Files provides comprehensive study materials, practice questions, case studies, reference guides, and direct Q&A access with the instructor — all designed to help you prepare for the MB(ASCP) examination.
Passing the MB(ASCP) examination depends on many factors within your control: your engagement with the materials, your consistency of study, your prior knowledge and experience, and your performance on exam day. Enrollment in this Course does not guarantee that you will pass the MB(ASCP) examination or any other examination. No representation, warranty, or guarantee of exam outcome is made or implied.
The Course is an educational tool only. It is not a substitute for clinical training, formal laboratory education, or supervised practice. Information presented is for examination preparation and general educational purposes; it is not medical advice or clinical guidance.
9. Payment, Refunds, and Cancellation
9.1 Payment
Course access is sold at the price displayed at checkout. All prices are in U.S. dollars. Payment is processed by Stripe; dogmaDECODER does not store credit card numbers.
9.2 Refund Policy
Within thirty (30) days of your purchase date, you may request a full refund for any reason — no questions asked. To request a refund, contact courses@dogmadecoder.com with your purchase information.
After 30 days, all sales are final and refunds will not be issued.
Refunds are based on satisfaction with the Course materials, not on exam outcome. The 30-day refund window applies regardless of whether you have attempted or sat for any examination. Refunds may also be denied where dogmaDECODER reasonably believes the User has violated Sections 4, 5, or 6 of these Terms (license, IP, or prohibited uses).
9.3 Chargebacks
Initiating a payment chargeback before contacting dogmaDECODER directly for a refund may result in immediate account termination and may be disputed by dogmaDECODER using the records of your acceptance of these Terms.
10. Account Termination
dogmaDECODER may suspend or terminate your account at any time for violation of these Terms, including but not limited to distribution of Course content, account sharing, or fraudulent payment activity. Termination for cause does not entitle the User to a refund.
You may close your account at any time by contacting courses@dogmadecoder.com. Account closure does not automatically trigger a refund; the refund window in Section 9.2 applies.
11. Disclaimer of Warranties
THE COURSE AND SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, DOGMADECODER DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
dogmaDECODER does not warrant that the Site or Course will be uninterrupted, error-free, or available at all times. dogmaDECODER makes no warranty that use of the Course will result in any particular examination outcome.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DOGMADECODER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE OR COURSE.
The total aggregate liability of dogmaDECODER for any claim arising out of or relating to these Terms, the Site, or the Course shall not exceed the amount you paid to dogmaDECODER in the twelve (12) months preceding the claim.
13. Indemnification
You agree to indemnify, defend, and hold harmless dogmaDECODER, Panisa Pochanard, and any agents or representatives from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your violation of these Terms, your misuse of the Course materials, or your infringement of any intellectual property or other right of any person or entity.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms shall be resolved exclusively in the state or federal courts located in California, and you consent to the jurisdiction of such courts.
15. Changes to These Terms
dogmaDECODER may update these Terms from time to time. Updated Terms will be posted to this page with a new version number and effective date. Material changes will be communicated to active enrolled users via email or in-app notification, and continued use of the Site or Course following such notification constitutes acceptance of the revised Terms.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
